The State of Texas, County of Lavaca, Probate Court, January Term 1866


To The Honorable Isham Sims Chief Justice of Lavaca County.
Your petitioner M. B. Bennet a citizen of the County of Lavaca and State aforesaid would respectfully represent to your Honor that J. B. Arnold a citizen of Said State and county departed this life some time in the Spring of the year 1866 leaving a considerable amount of property consisting in land & ests. Petitioner further represents that there is no Administration of said estate and that he is a creditor of the said J. B. Arnold. Wherefore he prays that he may be appointed Adm of said estate and in duty bound will ever pray as

Know all men by these presents that we M. B. Bennett as principal and A. K. Foster and B. B. Welkins as sureties are held and firmly bound unto the Chief Justice of the County of Lavaca in the sum of fourteen hundred dollars for the payment of which, well and truly to be made we bind our selves our heirs, executers and administrators, jointly and severally, firmly by these presents signed and sealed with our seals, the seals being scrawls this the 31st day of January 1866.
The Condition of the above obligation is such that whereas the above bounden M. B. Bennett has been appointed by the Chief Justice of the County of Lavaca, administrator of the Estate of James B. Arnold deceased.
Now, if the said M. B. Bennett shall well and truly perform all the duties required of him by law under said appointment, then this obligation shall be null and void other wise to remain in full force and effect.

I do solemnly swear that J. B. Arnold died without leaving any will so far as I know or believe and that I will well and truly administer said estate in accordance with the law to the best of my skill and ability so help me god {signed} M. B. Bennett
